OF VALUABLE REAL ESTATE
FRIDAY, NOVEMBER 5, 2010 AT 10:00 A.M.
By Order of the Circuit Court of Frederick County, Virginia, entered on May 13, 2010, in the case styled, Mary Ann Rumsey v. Charles Rumsey, Case No. CL06-53, the undersigned SPECIAL COMMISSIONERS will offer for sale at public auction on Friday, November 5, 2010, at 10:00 a.m. at the Courthouse steps of the Frederick County Circuit Court, located at 5 North Kent Street, Winchester, Virginia 22601, the following described real estate the improvements thereon:
1. All that certain lot or parcel of land lying and being situate in Gainesboro Magisterial District, Frederick County, Virginia, containing 5.000 acres, more or less, and designated as Lot 5, Mary’s Field Subdivision , on the plat and survey of H. Bruce Edens, L.S., dated February 25, 1991 and of record in the Clerk’s Office of the Circuit Court of Frederick County, Virginia, in Deed Book 761, at Page 1529. More commonly known as 311 Gardners Road, Cross Junction, Virginia; Tax Map No. 35201.
2. Property located at Lake Holiday Estates, known as Lot #144, SECTION 8A, Lake Holiday Estates.
This conveyance will be by Special Warranty Deed and will be subject to such conditions, restrictions, rights of way, easements and reservations in the chain of title to the property, if any, as found among the Land Records in the Frederick County Circuit Court Clerk’s Office. Taxes for year 2010 will be prorated.
TERMS OF SALE: The terms are: Cash or Cashier’s Check. There will be a 10% deposit down for the properties, on the day of sale, with the balance due upon delivery of Deed within 30 days at closing. Five percent (5%) buyers premium to be added to the last and highest bid at this auction to establish the final sale price. The properties shall be sold separately. The sale is subject to confirmation by the Circuit Court of Frederick County, Virginia: Hearing on confirmation of the sale will be held at 9:00 a.m., or as soon therefore, on November 4, 2010. If the sale is confirmed by the court, then Settlement shall be held within 30 days after the date of sale, that is, by December 4, 2010, unless otherwise postponed at the sole discretion of the Special Commissioners. The Property is sold AS IS. Time shall be of the essence with respect to settlement. The deposit shall be applied to the credit of successful bidder at settlement; or, in the event of failure to complete settlement within the time set forth after the date of sale, in accordance with the terms of sale, the deposit shall be forfeited and applied to the costs of sale, including Special Commissioner’s fees, and the property shall be resold at the cost and expense of the defaulting Purchaser, who shall remain liable for the full purchase price, less net proceeds of any re-sale. Current real estate property taxes will be prorated at closing.
